1. INTRODUCTION

1.1 These Terms & Conditions (“Terms”) govern the use of the electric vehicle chargepoint (“Chargepoint”) operated by Peppermint Group Ltd (“Peppermint”, “we”, “us” or “our”).

1.2 The Chargepoint is located within Thorncombe Road No. 3 Car Park (“Thorncombe 3”), which is owned and/or operated by Caerphilly County Borough Council (“the Council”).

1.3 Thorncombe 3 is a public pay-and-display car park and is subject to the Council's own parking regulations, tariffs, conditions of use and enforcement arrangements.

1.4 Peppermint does not own, operate or control Thorncombe 3 or the individual parking bays within it.

1.5 The Council has not designated the parking bays adjacent to the Chargepoint as exclusive electric vehicle charging bays. Consequently, Peppermint cannot guarantee that a parking bay immediately adjacent to or accessible to the Chargepoint will be available when a customer wishes to charge.

1.6 Peppermint provides the Chargepoint and the associated electric vehicle charging service only. The use of the car park remains subject to the Council's applicable parking terms and conditions.

1.7 Electricity supplied through the Chargepoint is charged on a pay-per-kilowatt-hour (kWh) basis at the tariff displayed to the customer before the Charging Session begins.

1.8 Payment and charging-management services are provided through Monta, a third-party electric vehicle charging and payment platform.

1.9 By connecting your vehicle to the Chargepoint, initiating a Charging Session and/or completing a payment transaction, you acknowledge that you have had an opportunity to read these Terms and agree to be bound by them.

1.10 If you do not agree to these Terms, you must not use the Chargepoint.

2. DEFINITIONS

For the purposes of these Terms:

“Chargepoint” means the electric vehicle charging equipment, socket, connector, cable where supplied, associated electrical equipment, payment equipment, software and related infrastructure operated by or on behalf of Peppermint.

“Charging Session” means the period commencing when a customer successfully initiates a charging transaction and connects their vehicle to the Chargepoint and ending when the charging transaction is terminated and the vehicle is disconnected.

“Charging Tariff” means the price payable for electricity supplied through the Chargepoint, expressed in pence per kilowatt-hour (p/kWh), together with any additional charges clearly disclosed to the customer.

“Customer”, “you” or “your” means the person using or attempting to use the Chargepoint.

“Monta” means the third-party electric vehicle charging management and payment platform used in connection with the Chargepoint.

“Monta App” means the Monta mobile application used to access, initiate and/or pay for charging services where applicable.

“Maximum Charging Period” means the maximum permitted period for a Charging Session, being two (2) hours, unless otherwise stated on the Chargepoint signage.

“Extended Charging Charge” means the additional charge which may become payable where a customer continues a Charging Session or remains connected to the Chargepoint beyond the Maximum Charging Period.

3. CAR PARK OWNERSHIP AND PARKING CONDITIONS

3.1 Thorncombe 3 is a Council-owned and/or Council-operated public car park.

3.2 Peppermint has no ownership or control over the car park or the individual parking bays.

3.3 The parking bays adjacent to the Chargepoint are not exclusively reserved for electric vehicles unless the Council subsequently designates them as such.

3.4 Any vehicle may therefore occupy a parking bay adjacent to the Chargepoint, whether or not that vehicle is electric or being charged.

3.5 Peppermint cannot guarantee that a customer will be able to access the Chargepoint at any particular time.

3.6 Peppermint has no authority to require another vehicle to vacate a parking bay solely because a customer wishes to use the Chargepoint.

3.7 Customers must comply with all Council parking requirements, including:

a. paying the applicable pay-and-display parking charge;

b. displaying or registering parking payment where required;

c. complying with any maximum parking period;

d. complying with parking restrictions;

e. parking within marked bays; and

f. complying with any enforcement arrangements operated by the Council.

3.8 Payment for electricity through the Peppermint Chargepoint does not constitute payment for parking.

3.9 Customers are responsible for paying any applicable Council parking charge separately from the electricity charging transaction.

3.10 Peppermint is not responsible for any Council parking charge, penalty, enforcement action, parking ticket, clamping, towing or other parking-related matter arising from use of Thorncombe 3.

3.11 Any parking dispute must be addressed directly with the Council or its appointed parking enforcement provider.

4. AVAILABILITY OF THE CHARGEPOINT

4.1 The Chargepoint is available for public use when it is operational and accessible.

4.2 Use is subject to availability.

4.3 Peppermint does not guarantee that the Chargepoint will be available at any particular time.

4.4 Peppermint does not guarantee that a parking bay adjacent to the Chargepoint will be vacant.

4.5 Peppermint may temporarily suspend or restrict the Chargepoint where reasonably necessary, including for:

a. maintenance;

b. inspection;

c. testing;

d. repair;

e. electrical works;

f. safety reasons;

g. technical failure;

h. vandalism or damage;

i. software or telecommunications failure;

j. emergency circumstances;

k. suspected misuse; or

l. circumstances outside Peppermint's reasonable control.

5. VEHICLE COMPATIBILITY

5.1 The Chargepoint may only be used to charge a compatible electric vehicle.

5.2 Customers are responsible for determining whether their vehicle and charging equipment are compatible with the Chargepoint.

5.3 Customers must ensure that their vehicle, charging cable, connector and any associated equipment are safe and suitable for use.

5.4 Customers must follow the vehicle manufacturer's and charging equipment manufacturer's instructions.

5.5 Customers must not use visibly damaged or defective charging equipment.

5.6 Customers must not modify, dismantle, interfere with or attempt to bypass any part of the Chargepoint.

6. MONTA APP AND PAYMENT

6.1 Peppermint uses Monta as its third-party charging management and payment platform.

6.2 Customers may be required to use the Monta App or another payment method made available at the Chargepoint to commence a Charging Session.

6.3 Where the Monta App is required, customers are responsible for:

a. downloading the Monta App;

b. creating or accessing a Monta account where required;

c. accepting applicable Monta terms and conditions;

d. providing a valid payment method; and

e. maintaining an active and authorised payment method.

6.4 The applicable Charging Tariff and any additional applicable charges will be displayed to the customer before the Charging Session is authorised.

6.5 Payment may be processed by Monta and/or its appointed payment service providers.

6.6 Monta may process payment authorisations, charging records, transaction information, receipts, refunds and other information required to provide its services.

6.7 Customers acknowledge that the Monta App and associated third-party payment services may occasionally experience technical, network or payment failures.

6.8 Peppermint is not responsible for failures caused solely by a customer's mobile device, mobile network, internet connection, bank, payment provider or Monta account.

6.9 Where a problem concerns the Monta App or Monta payment system, the customer may be required to contact Monta support.

6.10 Where the issue concerns the physical Chargepoint or Peppermint's charging service, the customer should use the support details displayed at the Chargepoint.

7. PAYMENT METHODS

7.1 The payment methods available at the Chargepoint will be displayed to customers.

7.2 Where required by applicable law, the Chargepoint will provide an appropriate ad-hoc contactless payment facility.

7.3 Contactless payment may be available in addition to payment through the Monta App.

7.4 Where contactless payment is available, customers may use an eligible contactless bank card or supported contactless payment device.

7.5 Customers are responsible for following the payment instructions displayed at the Chargepoint.

8. CHARGING TARIFF

8.1 Charging is provided on a pay-per-kWh basis.

8.2 The applicable Charging Tariff will be clearly displayed before the customer commences a Charging Session.

8.3 Any applicable additional charge will also be clearly disclosed before the Charging Session begins.

8.4 Peppermint reserves the right to amend the Charging Tariff from time to time.

8.5 Any revised tariff will apply to Charging Sessions commenced after the revised tariff becomes effective.

8.6 The amount payable for electricity will be calculated by reference to the electricity recorded as supplied by the Chargepoint's metering system, subject to correction where a confirmed fault or error has occurred.

9. MAXIMUM TWO-HOUR CHARGING PERIOD

9.1 Each Charging Session is subject to a maximum charging period of two (2) hours.

9.2 The Maximum Charging Period applies to the customer's use of the Peppermint Chargepoint and does not constitute a restriction on the customer's use of the Council car park.

9.3 The Maximum Charging Period begins when the Charging Session is successfully initiated.

9.4 Customers must terminate their Charging Session and disconnect their vehicle before the Maximum Charging Period expires.

9.5 The Maximum Charging Period applies whether or not:

a. the vehicle is still actively receiving electricity;

b. the vehicle has reached its desired state of charge;

c. the vehicle is fully charged;

d. charging has stopped automatically;

e. the customer has left the vehicle unattended; or

f. the customer has forgotten to return to the vehicle.

9.6 Customers are responsible for monitoring their Charging Session and ensuring that they do not exceed the Maximum Charging Period.

10. EXTENDED CHARGING CHARGE

10.1 The Chargepoint is intended to provide reasonable access to charging facilities for multiple users.

10.2 Customers who commence a Charging Session agree that the Charging Session is limited to the Maximum Charging Period of two (2) hours.

10.3 An Extended Charging Charge may apply where a customer continues their Charging Session or remains connected to the Chargepoint beyond the Maximum Charging Period.

10.4 The Extended Charging Charge is a charge associated with continued use of the Peppermint charging service beyond the advertised Maximum Charging Period.

10.5 The Extended Charging Charge is not a Council parking penalty, parking fine or parking enforcement charge.

10.6 The Extended Charging Charge does not apply merely because a vehicle is parked in a parking bay adjacent to the Chargepoint without being connected to and using the Peppermint charging service.

10.7 The Extended Charging Charge will be clearly displayed at the Chargepoint before the Charging Session begins.

10.8 The proposed Extended Charging Charge is:

£10.00 per hour or part thereof following the Maximum Charging Period and will be charged after a ten-minute grace period.

10.9 Where technically available, the charging management system may provide a warning or notification before the Extended Charging Charge becomes payable.

10.10 Peppermint may use Monta or another appointed charging management system to record:

a. the start of the Charging Session;

b. the duration of the Charging Session;

c. the amount of electricity supplied;

d. the time at which the Maximum Charging Period expires; and

e. any applicable Extended Charging Charge.

10.11 Customers are responsible for terminating their Charging Session within the Maximum Charging Period.

10.12 Peppermint may restrict future access to the charging service where a customer repeatedly exceeds the Maximum Charging Period or otherwise misuses the Chargepoint.

11. PARKING WITHOUT CHARGING

11.1 Peppermint recognises that the parking bays adjacent to the Chargepoint are not exclusive EV charging bays.

11.2 Peppermint therefore accepts that another vehicle may occupy a bay adjacent to the Chargepoint without using the charging facility.

11.3 Peppermint does not issue or enforce parking penalties against vehicles occupying those bays.

11.4 Customers wishing to use the Chargepoint should only attempt to do so where the Chargepoint can safely be accessed.

11.5 Peppermint accepts no liability for a customer's inability to use the Chargepoint because another vehicle is occupying a nearby parking bay.

11.6 Any dispute concerning the occupation of a parking bay must be addressed to Caerphilly County Borough Council.

12. COMMENCING A CHARGING SESSION

12.1 Before commencing a Charging Session, customers should:

a. check the Charging Tariff;

b. check the Maximum Charging Period;

c. check the applicable Extended Charging Charge;

d. check that their vehicle and charging equipment are compatible;

e. ensure that their charging equipment is safe; and

f. ensure that any required Council parking payment has been made.

12.2 Where the Monta App is required, the customer must select the correct Chargepoint and confirm the relevant transaction.

12.3 Customers are responsible for ensuring that they select the correct Chargepoint.

12.4 By initiating the Charging Session, the customer agrees to the applicable Charging Tariff and Maximum Charging Period.

13. TERMINATING A CHARGING SESSION

13.1 Customers must terminate their Charging Session in accordance with the instructions displayed at the Chargepoint.

13.2 Customers must disconnect their vehicle before the Maximum Charging Period expires.

13.3 Customers must not disconnect another person's vehicle.

13.4 Customers must not interfere with another customer's Charging Session.

13.5 Customers must safely remove and store their charging cable where the cable belongs to them.

14. SAFETY

14.1 Customers must use the Chargepoint responsibly and comply with all displayed safety instructions.

14.2 Customers must not:

a. use damaged charging equipment;

b. interfere with electrical or electronic components;

c. dismantle the Chargepoint;

d. bypass safety systems;

e. damage or vandalise the Chargepoint;

f. obstruct the Chargepoint;

g. create trip hazards; or

h. use the Chargepoint for any purpose other than charging a compatible EV.

14.3 Customers must stop using the Chargepoint where they identify an immediate safety risk.

14.4 Significant faults or safety concerns should be reported using the support details displayed at the Chargepoint.

15. MAINTENANCE, INSPECTION AND TESTING

15.1 Peppermint will arrange appropriate maintenance, inspection and testing of the Chargepoint having regard to applicable requirements, manufacturer instructions and its intended use.

15.2 Peppermint will take reasonable steps to maintain the Chargepoint in a safe and serviceable condition.

15.3 Appropriate maintenance and testing do not guarantee that the Chargepoint will remain free from faults.

15.4 Electrical, mechanical, software, payment, telecommunications and network failures may occur despite appropriate maintenance and testing.

16. VEHICLE AND THIRD-PARTY EQUIPMENT

16.1 Customers remain responsible for their vehicle, charging cable, connector, adapter and other equipment.

16.2 Customers are responsible for ensuring that their equipment is compatible and safe.

16.3 Peppermint accepts no responsibility for damage arising from:

a. vehicle incompatibility;

b. pre-existing defects;

c. defective customer equipment;

d. misuse;

e. negligence by the customer;

f. failure to follow manufacturer's instructions;

g. unauthorised modifications;

h. customer-supplied charging cables or adapters; or

i. circumstances outside Peppermint's reasonable control.

16.4 Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited.

17. LIABILITY

17.1 Subject to applicable law, Peppermint will not be responsible for loss or damage resulting from circumstances outside its reasonable control.

17.2 Subject to applicable law, Peppermint will not be liable for indirect or consequential losses, loss of profit, loss of business or loss of anticipated savings arising from use or inability to use the Chargepoint.

17.3 Peppermint is not responsible for personal possessions left inside or around a vehicle.

17.4 Peppermint is not responsible for damage resulting from a customer's failure to comply with these Terms, Chargepoint instructions or vehicle manufacturer's instructions.

17.5 Nothing in these Terms:

a. excludes or limits liability for death or personal injury caused by negligence;

b. excludes or limits liability for fraud or fraudulent misrepresentation;

c. excludes or limits liability which cannot legally be excluded or limited; or

d. removes or restricts statutory consumer rights.

18. CHARGING INTERRUPTION AND TECHNICAL FAILURE

18.1 Peppermint does not guarantee uninterrupted operation of the Chargepoint.

18.2 Charging may be interrupted by:

a. electrical supply failure;

b. Chargepoint malfunction;

c. network or telecommunications failure;

d. payment system failure;

e. vehicle or vehicle charging-system faults;

f. safety protection systems;

g. software malfunction;

h. maintenance or repair;

i. emergency shutdown; or

j. circumstances outside Peppermint's reasonable control.

18.3 Where charging is interrupted because of a confirmed Chargepoint fault, customers should contact the support service displayed at the Chargepoint.

18.4 Where a customer has been charged for electricity which was not supplied because of a confirmed Chargepoint fault, the transaction will be investigated and an appropriate refund or adjustment may be provided where appropriate.

19. REFUNDS

19.1 Charging transactions are processed through Monta and/or its appointed payment service providers.

19.2 Refunds may therefore be processed through Monta or the relevant payment provider.

19.3 Customers should retain their charging receipt or transaction reference.

19.4 Refund requests should include, where available:

a. date and approximate time;

b. Chargepoint identification;

c. transaction reference;

d. amount charged;

e. vehicle registration number; and

f. details of the problem experienced.

19.5 Refunds will not ordinarily be provided simply because a customer:

a. chose not to use the full amount of electricity available;

b. voluntarily terminated the Charging Session early;

c. left before using the intended amount of electricity; or

d. incorrectly estimated the amount of electricity required.

19.6 Where the Chargepoint has demonstrably malfunctioned, a payment has been processed incorrectly, or a refund is required by applicable law, Peppermint will consider and process the matter appropriately.

19.7 Nothing in these Terms is intended to exclude any statutory right to a refund, price reduction or other remedy.

20. MONTA TERMS AND THIRD-PARTY SERVICES

20.1 Customers acknowledge that use of the Monta App and related services may be subject to separate Monta terms and conditions.

20.2 Customers should review the applicable Monta terms before using the Monta App.

20.3 Peppermint is not responsible for third-party services outside its reasonable control.

20.4 Third-party services may include:

a. payment processing;

b. charging management software;

c. mobile applications;

d. telecommunications;

e. network connectivity;

f. payment authentication;

g. customer notifications; and

h. technical support.

20.5 Where a problem arises solely from a third-party service, Peppermint may direct the customer to the relevant provider.

20.6 Nothing in these Terms removes or limits rights the customer may have against Peppermint in relation to matters for which Peppermint is legally responsible.

21. DATA PROTECTION

21.1 Personal information may be processed in connection with the operation of the Chargepoint.

21.2 Information may include:

a. charging transaction information;

b. date and time of use;

c. electricity consumed;

d. payment information;

e. Monta account information;

f. vehicle registration information where necessary; and

g. information provided when contacting customer support.

21.3 Payment information may be processed by Monta and/or its appointed payment providers.

21.4 Peppermint will process personal data in accordance with applicable UK data protection legislation and its Privacy Notice.

21.5 Where CCTV operates at the car park, CCTV will be subject to the relevant operator's applicable privacy and CCTV arrangements.

22. CUSTOMER SUPPORT

22.1 Customers experiencing a problem with the Chargepoint should use the support details displayed at the Chargepoint.

22.2 Where the issue relates to the Monta App or Monta payment system, customers may be directed to Monta support.

22.3 Where the issue relates to the physical Chargepoint or Peppermint's charging service, customers should contact the designated Chargepoint support service.

23. COMPLAINTS

23.1 Complaints concerning the Peppermint charging service should be submitted to:

23.2 Complaints concerning Council parking arrangements, parking charges or parking enforcement should be directed to Caerphilly County Borough Council.

23.3 Complaints should include sufficient information to allow the matter to be investigated, including the date, time, Chargepoint identification and transaction reference where applicable.

24. COMPLIANCE WITH LAW

24.1 Peppermint intends to operate the Chargepoint in accordance with applicable UK legislation and regulatory requirements governing publicly accessible electric vehicle chargepoints.

24.2 These Terms are subject to applicable consumer protection, electrical safety, data protection, payment and public chargepoint requirements.

24.3 Where a mandatory legal requirement conflicts with these Terms, the mandatory legal requirement will prevail.

24.4 Any provision found to be unlawful, invalid or unenforceable will, to the extent possible, be modified or severed without affecting the remaining provisions.

25. CHANGES TO THESE TERMS

25.1 Peppermint may amend these Terms where reasonably necessary, including because of:

a. changes in legislation;

b. regulatory requirements;

c. changes to the Chargepoint;

d. changes to payment arrangements;

e. changes to Monta services;

f. changes to tariffs; or

g. operational requirements.

25.2 The current version of these Terms will be made available through the method identified on the Chargepoint signage.

25.3 Changes will not retrospectively alter a customer's rights relating to a Charging Session already commenced, except where required by law.

26. ACCEPTANCE OF TERMS

26.1 By connecting your vehicle to the Chargepoint and commencing a Charging Session and/or completing the relevant payment transaction, you confirm that:

a. you have had an opportunity to read these Terms;

b. you understand the principal conditions governing use of the charging service;

c. you agree to pay the applicable Charging Tariff;

d. you agree to the Maximum Charging Period of two hours;

e. you acknowledge that an Extended Charging Charge may become payable if you exceed the Maximum Charging Period;

f. you understand that the car park is operated separately by Caerphilly County Borough Council;

g. you understand that payment for electricity is separate from any Council parking charge;

h. you agree to use the Chargepoint safely and responsibly;

i. you acknowledge that payment and charging-management services may be provided through Monta; and

j. you agree to be bound by these Terms, subject always to your statutory rights.

27. GOVERNING LAW AND JURISDICTION

27.1 These Terms and any dispute arising from or in connection with use of the Chargepoint shall be governed by the law of England and Wales, unless mandatory applicable law requires otherwise.

27.2 Subject to statutory consumer rights, the courts of England and Wales shall have jurisdiction over disputes arising in connection with these Terms.

CUSTOMER NOTICE – BEFORE YOU CHARGE

IMPORTANT INFORMATION

THIS IS A COUNCIL-OWNED PAY-AND-DISPLAY CAR PARK

The parking bays adjacent to this EV Chargepoint are not exclusively reserved for electric vehicles.

Another vehicle may therefore be parked in the vicinity of the Chargepoint.

Peppermint Group Ltd cannot require another vehicle to vacate a parking bay.

Any Council parking charges must be paid separately.

TO USE THE CHARGEPOINT

1. Check the charging tariff.

2. Check the maximum two-hour charging period.

3. Check the Extended Charging Charge.

4. Ensure your vehicle and charging cable are compatible.

5. Use the Monta App or other available payment method.

6. Start your Charging Session.

7. End your Charging Session and disconnect before two hours.

EXTENDED CHARGING

Maximum Charging Period: 2 HOURS

Extended Charging Charge: £10.00p per hour or part thereof after a ten-minute grace period.

The Extended Charging Charge applies to continued use of the Peppermint charging service beyond the two-hour maximum period.

It is not a Council parking penalty or parking charge.

IMPORTANT

By connecting your vehicle and commencing a Charging Session, you confirm that you have read and accepted the Peppermint Group Ltd EV Charging Terms & Conditions.
